1. Acceptance of Terms
By accessing or using Marketa at marketa.space, you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These Terms apply to all users, including those who connect Meta (Facebook/Instagram) Ads accounts.
2. Description of Service
Marketa is an AI-powered marketing platform that enables users to:
- Create, manage, and automate Meta (Facebook/Instagram) ad campaigns
- Generate AI-powered ad copy and creative briefs
- Build marketing landing pages
- Monitor campaign performance and analytics
The Service integrates with the Meta Marketing API to perform ad management actions on behalf of users who have explicitly authorized such access via OAuth.
3. Account Registration
You must create an account to use the Service. You agree to provide accurate, current, and complete information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old to use the Service.
4. Meta Platform Integration
Authorization
When you connect your Meta Ads account, you grant Marketa permission to access and manage it on your behalf — including creating, modifying, and deleting campaigns, ad sets, and ads. You may revoke access at any time via Facebook App Settings or within the Marketa platform.
Compliance with Meta Policies
You agree to use the Meta integration only in compliance with Meta Advertising Policies, Meta Platform Terms, and all applicable laws. You are solely responsible for the content of ads created through the Service.
Ad Spend Responsibility
Any ad spend incurred through campaigns created via Marketa is billed directly by Meta to your Meta Ads account. Marketa has no liability for ad spend charges. You are responsible for monitoring your Meta Ads billing.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Create or distribute ads that are deceptive, discriminatory, or violate Meta's advertising policies
- Reverse-engineer, scrape, or circumvent any security measure of the Service
- Access another user's account without authorization
- Send spam or unsolicited communications
- Infringe on any third party's intellectual property rights
6. AI-Generated Content
The Service uses AI to generate ad copy and campaign recommendations. You acknowledge that:
- AI-generated content is provided "as is" and may not always be accurate or suitable
- You are solely responsible for reviewing and approving AI-generated content before publishing
- Marketa does not guarantee that AI-generated content will comply with Meta advertising policies
7. Intellectual Property
The Marketa platform, design, code, and branding are owned by Marketa and protected by intellectual property laws. You retain ownership of all content and data you provide. By using the Service, you grant Marketa a limited, non-exclusive license to process your data solely as necessary to provide the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not warrant that the Service will be uninterrupted or error-free, nor do we guarantee any specific advertising results or return on ad spend.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MARKETA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. Data deletion follows our Privacy Policy.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Continued use after changes constitutes acceptance.
